What to Expect from a Mass Tort Settlement

Mass tort settlements rarely look like the headlines. Here is a realistic walkthrough of timing, valuation, fees, and what actually ends up in your pocket.

Timing

Mass tort MDLs typically take three to seven years from formation to settlement, and another six to twelve months from settlement announcement to payment. There is no fast path.

How cases are valued

After bellwether trials, plaintiffs and defendants negotiate a settlement "grid" or "matrix" that assigns point values to different injury types, severities, and durations. Your case is scored against the matrix to produce a settlement number.

High-value factors typically include surgery, repeated hospitalizations, permanent disability, lost income, and severe documented pain. Low-value factors include short symptom duration, mild severity, and gaps in medical records.

Attorney fees and costs

Mass tort attorneys work on contingency — typically 33% to 40% of the gross recovery, plus reimbursement of case expenses (medical records, expert review, MDL-wide common-benefit assessments). The fee structure is disclosed in your retainer agreement up front.

Liens and offsets

If Medicare, Medicaid, or a private insurer paid for treatment, they have a lien on your recovery for those amounts. The firm negotiates liens down where possible before disbursing your net check.

Global vs. individual settlements

Most MDLs end in a "global" settlement — a single deal covering thousands of plaintiffs with each case valued by the matrix. A small number of cases proceed individually to trial. Either path is possible.
